||ERISA defines a year of service in terms of 1,000 compensable hours during a consecutive 12-month period. - For purposes of the participation rules, an individual has one year of service if he or she works for 1,000 hours during the initial 12-month period after he or she is employed. Assuming that he or she has reached age 21 (and that the plan is not one that requires a three year waiting period), the employee who has met the above requirement must be permitted to participate in the plan on the earlier of (a) the beginning of the first plan year after the anniversary date of his or her employment or (b) six months from the anniversary date of his or her employment. If an employee fails to work 1,000 hours during the initial 12 months of his or her employment, he or she must begin meeting the 1,000-hour requirement in the next 12-month period. For purposes of determining where an individual stands on the vesting schedule, a year of service is a calendar year, plan year or other consecutive 12-month period designated in theplan during which the employee worked 1,000 hours. - Special rules govern the maritime industry and certain seasonal industries.
